These Terms and Conditions (“Terms”) govern the use of WLCMBCK (“Service”) provided by Rabid Robot LLC, a U.S.-based limited liability company (“we”, “us”, “our”) to businesses (“Client”, “you”) engaging in our QR code-driven email marketing platform.

1. Service Overview

WLCMBCK provides Clients with a branded canvas containing a QR code. When a customer scans the code and enters their details, they are added to a marketing list, through which we send campaigns and offers on the Client’s behalf. An incentive (e.g. a free cookie) is typically offered in exchange for sign-up.

2. Client Responsibilities

  • Prominently display the canvas/QR code provided.
  • Offer a real incentive for customer participation (A discount, free item etc, extra service etc…)
  • Ensure compliance with any local marketing, health, or promotional laws.

3. Data Consent & Collection

All data is collected directly from users with clear consent, stored securely, and only used for marketing on behalf of the Client. Users may unsubscribe or request data deletion at any time.

4. Data Protection Compliance

We act as a Data Processor, and the Client is the Data Controller. We fully comply with:

  • GDPR (EU)
  • UK GDPR
  • CAN-SPAM Act (USA)
  • Privacy Act 1988 (Australia)

Data is encrypted, access is limited to authorized personnel, contractual and secure third party service providers, and subject data rights are honored as soon as the request is processed.

All personal data is encrypted in transit and at rest, and access is strictly limited to authorized personnel. Where we engage with third-party service providers (e.g., technical partners) for the purpose of delivering our services, such providers are contractually bound by GDPR-compliant Data Processing Agreements (DPAs), ensuring equivalent security, confidentiality, and lawful data handling practices.

These providers act under our instructions and are prohibited from using personal data for any other purpose.

We uphold all data subject rights under the GDPR, including access, correction, and deletion, which are honored promptly upon receipt and verification of a valid request.

5. Intellectual Property

All creative materials, QR codes, and campaign assets are the property of Rabid Robot LLC and licensed to the Client for use during active service.

6. Termination & Data

Either party may terminate service with 30 days’ notice. We will delete data upon request, unless required to retain it under applicable law.

7. Limitation of Liability

Rabid Robot LLC shall not be held liable for:

  • Client-side misuse of data or marketing materials
  • Non-compliance with local laws
  • Service interruptions outside of our control

8. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States. For Clients in the EU, UK, or Australia, these Terms shall not override any mandatory local data or consumer protection rights.
